Over the past few years, with the rise of generative AI legal-research and drafting tools, we’ve seen a corresponding rise in filings that are, at best, sloppy. At worst, they’re bad enough that the attorneys signing them are opening themselves up to potential sanctions or disciplinary action. No ethical attorney would make up a fake case to support their argument or knowingly misstate the proposition or holding of a real case. Yet, generative-AI tools continue to do exactly that, and with alarming regularity. The attorney who relies on an AI tool without vetting everything it produces does so at his or her peril.
